BARRED FROM NUMEROUS GOVERNMENTAL COMPUTER NETWORKS FOR TELLING THE TRUTH

Mayor and City Commissioners,

I am writing to request an investigation by the City Commission, State Attorney’s Office, Florida Department of Law Enforcement and the Commission on Ethics and Public Trust. The below highlighted City of Miami Public Officials have engaged in alleged misconduct that may be illegal or unethical. In January 2015, several Commissioners advised the City Manager that he would be held accountable for the performance of the Chief of Police. In the September 2015, during a special Commission Meeting, a City of Miami resident complained about the City Manager and the Police Chief's Job performance. The resident told Commissioners that he will be asking for the removal of both individuals in the near future.


In the past few weeks, the City Manager has promoted three unqualified political cronies to critical positions within the City to gain favor and votes to protect his job. The City Manager promoted Police Officer Rey Carvil to Commander of Police, Officer Louis Camacho to Sergeant of Arms and Mrs. Vanessa Acosta to N.E.T. Director. Officer Carvil was previously the Sergeant of Arms (appointed position) for Mayor Regalado. His job is to be the armed driver of the Mayor. His DROP is scheduled to end in six months in 2016. Officer Carvil has never held or obtained any command experience within the police department.  Additionally, because of his lack of experience, Officer Carvil was recently assigned to the Community Relations Unit and not the “vacant” Commander’s position in Brickell.  Brickell is one of the most important and fastest growing neighborhoods in the City of Miami that’s currently experiencing a developing boom. If you research crimes and calls for service statistics, the Brickell area has led the City of Miami in calls for service requests both in 2013 and 2014. It’s obvious this appointment was done to secure the Mayors veto power and prevent the removal of the City Manager from office.   The City Manager is actively attempting to change the city's ordinances in order to allow more cronyism.


Both Officer Louis Camacho and Mrs. Vanessa Acosta are affiliated to Commissioner Willy Gort. These individuals have worked and contributed to his political campaigns. Mrs. Acosta family ties to Chairman Gort are known and documented. Mrs. Acosta has no experience working with diverse communities, executive management, or has any knowledge of the NET program concept. Officer Camacho has never obtained any training or experience to qualify him for this assignment. None the less, Detective Tillman (African American) who has previously substituted in the absence of the Sergeant of Arms was not given the opportunity. Once again, these appointments were made by the City Manager to solidify Commissioner Gort’s vote to deter his removal.


In the past three years, the City Commission has budgeted and authorized the City Manager and Police Chief to hire additional police officers. Chief Orosa was purposely disingenuous to the City Commission in order to hide their incompetency and inability to manage and follow directives. The figures and statistics provided by Chief Orosa to commissioners were inaccurate and deceptive in nature. The current administration has also been publicly scolded by Commissioner Sarnoff and residents for similar actions. On September 2, 2015, the City Manager authored a memorandum to the Mayor and Commissioners on police hiring strategies and Implementations. In the memorandum, the City Manager was misleading regarding the following facts:


Training- City of Miami police officers have not received any of the training highlighted in the Manager's memorandum or in the DOJ investigation report. All current training is solely focused on cadets and academy training. The department as a whole has not been properly trained to manage incidents involving: mentally ill individuals, active shooter incidents, active shooter rescue training with fire department, cultural diversity training, racial profiling training, sensitivity training, chemical weapons attack training, and other essential training. The lack of training within the organization is so pervasive that officers have “not” been re-certified with their issued Taser’s as mandated by Florida State Statute. 

   

Overtime- For several years the police department has been using overtime during the months of July through September to address crime and the critical staffing shortages prior to the close out of the budget year. In the Managers memorandum, he stated that there was an increase of “89” additional sworn police officers throughout those months. What he failed to mention was that “60” officers had left the department during that period. The police force did not increase its sworn personnel “89”, but instead used overtime to augment vacancies and staffing shortages. Overtime usage is not a new innovative solution but an appendage for addressing individual deficiencies. The manager’s collusion with the police chief was intended to create a perception that he had not failed at doing his job. 


Violent Crime- In his memorandum, the City Manager gloats about the reduction in violent crimes and Part I crimes in the City of Miami. He states that both violent crime and Part I crimes have decreased in comparison to other major cities with similar officer to resident ratio. In 2014, the police department experienced a high of 89 homicides. Currently, the police department is on pace to surpass last year’s homicide rate. Additionally, Citywide in 2015, firearm arm offenses are up 300%, robberies 10%, shootings 28%, and persons crimes 7%.  The City Manager also failed to mention that the numbers of arrests made by police officers are down 20%.  The comparisons in his memorandum relates to the 417 thousand city residents and not the estimated 1 million transient populations transcending in the City of Miami during day time hours. Once again, this comparable was omitted in the Managers memorandum because it would skew the City Managers analysis.


Attached you will find a short video that highlights the current disarray and misconduct being exhibited by City leadership. The video illustrates the chief’s former secretary and girlfriend (Mrs. Barbara Maria Zayon Mendizabal) enjoying leisure time during work hours. Mrs. Barbara Maria Zayon Mendizabal is also the sister of Angel Zayon, Communications Director for the City of Miami. Mrs. Mendizabal states quite frequently within our unit how she is untouchable due to her relationship with the Police Chief.  Upon his promotion, the Chief transferred her and created a phantom position in the Special Investigation Section. His girlfriend never interviewed, obtained a clearance check, or met any requirements for working in a sensitive and specialized Section. If you compared the time stamps on the videos/photos that were given to the outside agency, it will clearly show she is not at work when she is supposed to. The Special Investigations Section oversees terrorist activities, major narcotics cases, money laundering, organized crimes and an array of highly complex investigative cases.


I will conclude by stating that the Mayor and the Commissioners should not ignore these serious allegations. You are required by oath and charter to take the appropriate actions. A series of surveillance videos, photos and reports of both subjects have been given to an outside agency. We are sharing small portions of this information because we know it will take time for the outside agency to properly investigate this. We also understand that the parties involved will attempt to identify who is reporting this (checking EID/RFID readers, red light cameras, etc). We assure you that has been addressed. We will also forward this letter to the media and proper governmental agencies for investigation.
