Coconut Grove architect Charles Corda who detailed some of the possible financial problems with the Skyrise Tower that I included in Part  XI of my series on the Skyrise Tower project, filed a lawsuit in Miami-Dade Circuit Court on Tuesday seeking an emergency hearing in order to challenge the ballot language in the referendum that the Miami City Commission voted on last month as part of a requirement for amending the Bayside marketplace lease.

ANOTHER BAD DEAL FOR MIAMI


Dear Friends, Neighbors and Colleagues;


Today I filed a Lawsuit against the City of Miami and the Miami-Dade County Elections Department, asking that the Ballot Item containing both the renovation of Bayside MarketPlace and the SkyRise Observation Tower be stricken from the August 26 Ballot in its present form.


In my view there are a number of reasons why this combined ballot question should not be allowed to go forward. Foremost, I believe that we should have the right to vote on these two projects separately and as such they should not have been combined within one Ballot Question.


For clarification purposes I have not asked that these items be permanently removed from the ballot but only that they should be split into two separate ballot questions. If this case moves quickly, and the " Injunctive Relief" I have requested is granted, it may be possible for the City to have new ballot questions developed and printed for the August 26 Referendum. If time does not allow that, then the ballot questions may be before you in November.
