Last year I wrote about the lawsuit that the Miami-Dade Tax Collector had filed against the City of Miami and Scott Wessel and Grove Key Marina over the alleged failure or one or both of these parties to pay ad valorem taxes on the property for almost 17 years.  After a rather interesting and informative hearing the judge determined that it was the City’s responsibility and not Wessel’s for the payment of those taxes, and the 3 DCA upheld that verdict.

A separate lawsuit filed by Weseel was also making its way through the courts at the same time over the allegation made by the City’s Independent Auditor that Grove Isle Marina had failed to properly pay the City its percentage of profit on the sale of fuel at the boat dock.

That lawsuit was recently settled, and it was the City who agreed to pay Wessel’s attorney’s costs as a way to get out from under.  The payment was made in the form of a rent credit, and here is that portion of the agreement.

Scott Wessel leaves the arena vindicated.
