SUNSHINE DISAPPEARING AT DDA
THE DDA USED TO POST THEIR AGENDAS AND MEETING MINUTES ON THEIR WEBSITE.  NOT ANYMORE

Until July of this year the DDA posted the agenda and minutes of their monthly board meetings on their website. For whatever reason, they seem to have quit doing that.


Missing are the minutes of the July Board Meeting, the agenda and minutes of the September Board Meeting, and the agenda for this Friday’s Board Meeting.


Are there items being discussed that the DDA doesn’t want the general public to know about?  One example that this might be the case was an email that I discovered in the batch of emails that were included in the lawsuit filed by Stephen Herbits and Sharon Kirby Wynne on behalf of numerous Venetian Island residents against the City of Miami to stop the Flagstone project on Watson Island.


The email was about an item related to the Flagstone project that Commissioner Sarnoff arbitrarily had removed from the DDA agenda when he learned that the Miami Beach City Manager and others were coming to the meeting.

Given the date of this email, whatever discussion was had between the members  would have occurred at the July 18th Board Meeting.


Several days ago I revealed that the DDA is no longer following the term limits set in the By-Laws for Board Members, a serious problem for an agency that operates on public money collected through a tax levy. 


What else might this collection of political insiders be doing that they’d rather not let the public know about? I know for sure that they’ve pretty much quit obeying the Public Records Law because not only was I forced to sue them in August, but in the aftermath of that lawsuit, Alyce Robertson is refusing to provide me with a copy of the DDA’s Check Register, or any documents related to how much money and staff time DDA employees spent during FY 2013-2014 working on the coffee-table promotional book for Sarnoff.


Are there other things that Executive Director Alyce Robertson might be trying to hide?


I believe so, and since she has decided to refuse to provide me with documents that I am legitimately entitled to ask for and receive, I am more than willing to start focusing on the Board Members who also have a responsibility to obey the law.


Are you listening Neisen Kasdin? You’re the Vice Chairman and a big shot lawyer, and that means you have more knowledge and responsibility than the average board member when it comes to ensuring that the Public Record Laws are obeyed.


You too Richard Lydecker. You’re a big boy player in the local legal establishment. You really want to be part of this bullshit? 


You and Kasdin have legal reputations to protect, and I’m beginning to think that there’s more of a reason than just thinking I’m an asshole as for why Alyce Robertson is refusing to provide me financial information about the DDA’s activities.


The big question is not whether I’m right, but whether I’m right and you two guys, along with the rest of the board want to become willing enablers in Alyce Robertson’s refusal to obey the Public Records Law. If I have to file another lawsuit against the DDA over public records, I’m going to start filing complaints against all of you with the Florida Bar for failing to uphold your responsibilities as Officers of the Court. Alyce Robertson is your employee. There are no exemptions applicable for the documents I’ve asked for , so either instruct her to obey the law, or as they say on the streets, ‘You might beat the rap, but you ain’t gonna beat the ride.’
